A recent brain injury lawsuit in Ohio shows the legal action victims can take against hospitals if their negligence leads to a serious injury. A couple filed a medical negligence claim against Ohio State University's Wexner Medical Center after their newborn son suffered brain damage during the delivery in 2006.
The lawsuit claimed that the hospital and obstetrician were negligent in their actions during the delivery. The lawsuit said that the doctor failed to manage the woman's labor and did not decide quickly enough that an emergency cesarean section was needed, which resulted in the baby suffering brain damage from a lack of oxygen during labor.
The court reviewing the medical malpractice lawsuit said that in addition to the doctor failing to have the emergency C-section right away, the doctor did not administer drugs properly during the woman's labor and the baby did not receiving enough blood and oxygen before the C-section was performed.
The couple's baby suffered a brain injury and requires constant medical care by his mother. The family should be able to take better care of their child now that medical malpractice claim has been settled with the medical center.
The medical center agreed to settle the claim for $5.25 million. The medical center's spokesperson said that they believe the settlement is fair and the family also agreed that they were happy with the settlement.
This case shows how victims of medical negligence that leads to a brain injury or birth injury can pursue legal action the doctors and medical staff responsible for the injury.
