For residents of some states however, the ability to file a lawsuit in situations such as these could soon be rescinded. Recently, several states have taken up legislation that, if passed, would make it impossible for those parents to sue in those situations. Some believe the idea behind these bills is to prevent parents from aborting fetuses after learning about fetal problems. Accordingly, the legislation is quite controversial.
Though these kinds of medical malpractice lawsuits are rare, the ones that are filed are generally quite complicated. While receiving monetary damages in a successful case no doubt assists with medical bills that are inevitable in these situations, it is highly likely that most parents would gladly trade all the money in the world in return for a healthy child.
