In Ohio, pedestrians are left vulnerable in the face of negligent drivers. Texting, talking on the phone, fussing with the radio, using excessive speed and driving while fatigued are some of the most common examples that can have the direst of consequences in Ohio and elsewhere due to pedestrian accidents.
One Virginia pedestrian, just 23 years old, was struck and killed by a valet driver while she was on her way to a concert with her husband. Her husband was walking several paces behind her when he heard a gut-wrenching thud and looked up to see his wife stuck under the body of a BMW.
The 23 year old later died of severe head trauma. In a four-hour trial, the negligent valet driver was convicted in the victim's death due under charges of involuntary manslaughter. Sentencing will take place toward the end of July.
However, this could not be all that is in store for this negligent driver. He could also have a wrongful death law suit levied against him by the victim's family, if they so choose.
A successful law suit could mean compensation for the family's pain and suffering. Whether this transpires remains to be seen. Although this accident did not occur in Ohio, it reminds drivers of our state that it is critical to remain mindful while behind the wheel. Failing to do so will absolutely mean the severest of consequences.
