With the holiday season upon us, many Ohio residents are busy trying to find those last-minute gifts. Drivers rush from store to store in an attempt to find a good deal on those perfect gift items. As a result, some drivers may fail to pay adequate attention to the important task at hand. A man has filed a lawsuit against a driver who he claims struck him in a parking lot while he was walking to his car.
The man says the car and pedestrian accident occurred when he was exiting a store. While walking to his vehicle, the man says a female driver backed her vehicle out of a parking spot and struck him. The man has filed a lawsuit against the driver, claiming she was negligent in failing to keep a proper lookout while backing out of the parking spot.
As a result of the car and pedestrian accident, the man suffered serious injuries which required medical care. He has endured pain, suffering and lost wages. Additionally, his debilitating and painful injuries resulted in loss of enjoyment in everyday activities and life.
The man is seeking compensation in excess of $50,000 for his injuries and emotional trauma.
Drivers who fail to exercise reasonable care to avoid collisions run the risk of causing accidents such as this one. Thankfully, the pedestrian in this case will likely recover from his physical injuries. He will, however, likely require ongoing medical and rehabilitative care and may suffer permanent disability as a result.
