Most motorcyclist enthusiasts acknowledge there are many dangers and risks associated with riding a motorcycle. Oftentimes motorcycle accidents result when drivers of cars and trucks are not paying attention and fail to see a motorcycle. Some motorcycle accidents, however, do not involve other motor vehicles, but rather result from highway defects.
An Ohio man recently settled a personal injury claim for $300,000 for injuries he sustained in a motorcycle accident. The accident occurred as the man was attempting to merge onto a state highway. The man's motorcycle struck a large pothole which caused him to lose control of his motorcycle and crash.
As a result of the accident, the man sustained numerous injuries which required him to be hospitalized and undergo extensive physical therapy. The man's hospital and medical bills totaled $1.2 million. Additionally he reported losing more than $58,000 in wages as he was unable to work as a result of his injuries.
In the personal lawsuit, the man alleged the specific pothole his motorcycle struck had caused several other motor vehicle accidents. Likewise, he argued the state was well aware of the pothole's existence and yet did nothing to fix the road defect.
While the man was awarded $300,000 to settle his claim, the settlement amount pales in comparison to the pain and suffering he has endured as a result of his injuries. Motorcyclists or drivers who are involved in an accident caused by a defective highway or road would be wise to seek the advice of a legal professional.
